1. Scope of application
These terms of sale apply to all towing and roadside assistance services offered by TowOwl, including emergency towing, on-site repair, and vehicle transport.
2. Orders and quotes
Any order must be the subject of a detailed quote accepted by the client. The quote is valid for 30 days and becomes firm upon written acceptance by the client.
3. Financial Flow and Commission
TowOwl uses the Stripe Connect 'Platform' model. The Client pays the intervention amount directly to the Merchant (Towing Professional) via Stripe security. TowOwl collects a connection commission on each transaction, included in the displayed VAT-inclusive price.
4. Secure Payments
Payments are processed via a preconfigured Stripe form. TowOwl does not store any banking data. In case of cash payment accepted by the towing professional, the platform commission remains due by the Merchant.
5. Intermediary Role
The intervention is carried out under the exclusive responsibility of the Towing Professional. TowOwl is not a guarantor of deadlines, the technical quality of the breakdown service, or the safety of the towing, which fall under the direct Merchant-Client contract.
6. Right of Withdrawal and Emergency
In accordance with article L221-28 of the Consumer Code (and equivalent EU regulations), the right of withdrawal does not apply to breakdown or emergency repair services requested by the consumer and executed immediately. Any cancellation after validation triggers minimum travel costs.
7. Insurance and Claims
Any damage occurring during the intervention must be declared to the Merchant's professional liability insurance. TowOwl does not intervene in the settlement of material claims related to towing.
8. Disputes and Claims
In case of a dispute over an intervention or a payment, the User must initiate the Stripe mediation process or contact TowOwl support to facilitate a resolution between the Client and the Merchant.
